These Terms of Service ("Terms") govern your use of Promoto.io (the "Service"), operated by Archieboy Holdings, LLC ("Promoto," "we"). By creating an account or using the Service, you agree to these Terms.
Promoto is an AI-managed paid advertising service. You connect your own ad accounts on supported networks (Google Ads, Meta, LinkedIn, and others added over time); Promoto's AI plans, launches, and optimizes campaigns on those accounts within guardrails you set (daily spend cap, geography, audience exclusions, etc.).
This is important to understand:
Promoto's planner and copywriter use AI (currently Anthropic's Claude and Google's Gemini image models) to draft campaign plans, ad copy, and creative images. You review and approve every campaign before it launches; nothing goes live without your explicit click.
AI output is best-effort and may contain errors, inaccuracies, or content that doesn't perfectly match your brand. You are responsible for reviewing AI-drafted campaigns and ad copy before approving them, and for ensuring they comply with each ad network's policies and applicable advertising law (FTC, CAN-SPAM, truth-in-advertising, your industry's regulations, etc.). Promoto and its AI providers are not liable for outcomes — positive or negative — of campaigns you approve.
Once you approve a campaign and link an ad account, Promoto runs nightly optimizations — pausing low-performing keywords, adding negative keywords from junk search terms, pausing underperforming ad variants, and (with your approval) drafting challenger creatives. All optimizer actions are subject to your guardrails (daily spend cap, geography, exclusion lists) and a 4-layer safety check that prevents non-reversible or runaway actions. Every decision is logged in your campaign's audit trail.
You can pause Promoto's optimizer at any time, kill any individual campaign, or revoke ad-network access entirely.
We may suspend or terminate your account if you breach these Terms, abuse the Service, or use Promoto for prohibited content. We'll attempt to notify you before termination unless the breach makes notice impractical (e.g. fraud, abuse).
Upon termination: your linked ad-network OAuth tokens are revoked; ad campaigns Promoto launched stay in your ad-network accounts (you own them); your Promoto account data is deleted within 30 days per our Privacy Policy.
Ad copy and creative images Promoto generates for your campaigns are yours to use within and outside the Service. The Promoto product, brand, and underlying code are owned by Archieboy Holdings, LLC.
The Service is provided "as is." We do not warrant that ads will produce any specific number of clicks, conversions, sales, or return on investment. Ad network algorithms, market conditions, your offer's competitiveness, and many other factors outside Promoto's control affect results.
To the maximum extent permitted by law, Promoto's aggregate liability for any claim arising from the Service is limited to the management fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages — including ad spend, lost profits, or campaign underperformance.
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflicts-of-law principles.
Material changes will be communicated by email and a dashboard notice at least 7 days before taking effect. Continued use of the Service after that constitutes acceptance.
